抗議声明
教育基本法「改正」法の成立にあたり、
政府・与党に対して厳しく抗議するとともに、
皆さんに、日本国憲法、そして、準憲法たる真の「教育基本法」
(昭和22年法律第25号)にもとづいて教育を推進することを訴える

本日、参議院本会議は、現行の教育基本法を実質的に廃止し、全く新しい法律にする
政府提出「教育基本法の全部を改正する法案」を可決・成立させた。徹底審議を求める
多くの国民の声を無視しこのような採決を行ったことは暴挙であり、厳しく抗議する。
現行の教育基本法は、戦前の教育が日本の軍国主義と極端な国家主義に奉仕したこと
を真剣に反省し、平和と民主主義、そして個人の尊厳の実現を求める日本国憲法の精神
を体現して制定された文字通り、教育の憲法であり、準憲法的な性格をもつものである
。
しかるに政府「改正」法案は、前文で「我々日本国民は、たゆまぬ努力によって」と
いう言葉で戦前と戦後を連続したものととらえることで戦前教育の問題点を免罪し、さ
らに「伝統を継承」という言葉で大日本帝国憲法下での諸価値を復権させようとしてい
る。
また今国会の論議では、政府「改正」法案は自民党新憲法草案の精神と一致するとい
う驚くべき答弁も文部科学大臣から行われている。
改正「教育基本法」は名前こそ「教育基本法」であるが現行教育基本法とは内容にお
いても性格においても似ても似つかぬものになった。
第一に、政府「改正」法案は、日本国憲法ではなく、自民党新憲法草案の精神にもと
づき作成されたものであり、日本国憲法に違反する法律となった。
第二に、国民に「国を愛する態度」や「公共の精神」を強制するもので、内心の自由
を侵害するものであり、さらには、法律に基づきさえすれば教育にフリーハンドで干渉
する権限を行政に与えるものなので、教育の自由を侵害するものである。これらは立憲
主義の精神を否定するものである。
第三に、現行教育基本法は、憲法13条の「個人の尊重」を第1条に規定された教育の
第1目的としての「人格の完成」に、憲法14条の「法の下の平等」を第3条「教育の
機会均等」と第5条「男女共学」に、というように日本国憲法の条文の中から教育に関
係する部分をとりだし、それを教育に即して具体化したという性格を持っている。しか
し政府「改正」法案の条文の多くは憲法上の根拠をもたないばかりか、それと反するも
のであり、「準憲法的性格」を喪失した。
改正「教育基本法」は、「教育基本法」という名前の普通の法律となった。それゆえ
教育における国家の役割に関する最高の指針は日本国憲法のみが指し示すこととなった
。改正「教育基本法」の解釈・運用にあたっては日本国憲法の精神・理念にもとづき行
われなければならない。また、今後「教育基本法」に関連する法律(33本)、政令、省
令、学習指導要領の改正が行われるが、いずれの場合にも憲法の規定に整合することが
求められる。
教育基本法「改正」後は、改正法を具体化する法改正とそれに基づく行政が展開する
。教育基本法の「改正」の問題点はこれから本格的に顕在化するのであり、「改正」法
を排除するための闘い、日本国憲法と準憲法である真の「教育基本法」(昭和22年法律
第25号)の理念・精神を実現する闘いは、これからが正念場である。今まで以上の闘い
が求められる。
「教育基本法」の再改正を目指し、日本国憲法の精神・理念に基づいた教育の実現を
目指し、われわれ教育基本法「改正」情報センターは今後も努力を続ける。

声明 「国民の声を無視し、数の暴力によって教育基本法「改正」法案を強行 成立さ
せた愚行に強く抗議する」
私たち大学関係7団体は、高等教育に深く関わる立場から、初めての共同行動 として
12月7日に全国の仲間とともに、国会内集会を成功させるとともに議員や 政党への要請
と国会傍聴を行った。また、審議が大詰めを迎えた12月13日、14 日にも共同で議員要
請と傍聴を行った。
しかし、私たちも含めて慎重審議を求める国民の圧倒的多数の声を無視し、参 議院教
育基本法特別委員会は12月14日午後6時過ぎに採決を強行した。さら に、参議院は会
期末の12月15日、本会議において、教育基本法「改正」法案を 与党の賛成多数で強行
成立させた。私たちは、これら一連の、国民無視、数の暴力による採決に断固抗議する
ものである。
そもそも、従来の教育基本法は戦前の皇国教育、軍国教育への痛苦の反省から 生まれ
、「基本的人権の尊重」・「戦争放棄・平和主義」・「国民主権」を柱 とする日本国
憲法のもとで、その理念を教育において具現化する根本法として 制定された。
私たちは憲法と従来の教育基本法の理念を高等教育の場において生かし、実現 するこ
とを目標に日々、教育と研究・医療に携わっている。私たちに今求めら れているのは
、それらの精神と理念が生かされているのかを教育のすべての面で検証することであり
、現在の教育行政と教育現場で生起しているさまざまな 問題・課題を解明し、解決す
ることである。にもかかわらず、政府与党は明確 な提案理由を提示することもなく、
教育基本法の「改正」を数の暴力によって 強引に推し進めた。慎重審議を求める圧倒
的多数の国民の声、徹底審議を求める各界各層の声を無視するとともに、これら喫緊の
問題・課題を教育基本法との関わりで十分に解明する審議を放棄し、採決を強行した。
「改正」法案は、教育は「人格の完成」をめざし、「公権力の介入・統制」等「不当な
支配」に屈することなく、「国民に直接責任をおっておこなわれ」なければならない、
とする崇高な普遍的理念を掲げた従来の教育基本法の理念を根底的に否定するものであ
り、現行憲法の精神と理念に反しているという強い懸念も払拭されていない。
私たちは公的権力による教育統制、内心の自由と学問の自由を脅かすあらゆる策動に反
対する。競争と格差を拡大し、青少年を「日本」に役立つか否かの判断基準で選別する
教育を許さない。日本を再び戦争する国にする教育に反対する。
私たちは、国会における暴挙に抗議するとともに、引き続き、憲法と従来の教育基本
法の理念の実現に向け奮闘することをあらためて宣言する。

ruling party that has held power for decades.
Now it turns out most of the meetings were staged, with officials posing as or
dinary citizens lobbing softball questions _ sparking a scandal that has deepl
y embarrassed the troubled government of Prime Minister Shinzo Abe.
After the scandal broke Wednesday following a special probe, a red-faced Abe a
nd several top lieutenants were forced to forfeit months of pay in penance, a
painful blow to a new government that was already sliding in the popularity po
lls.
"It is very regrettable that this kind of goings-on occurred," Abe told report
ers after receiving a report by a Cabinet commission on Wednesday, which showe
d that 60 percent of the 174 town meetings held since 2001 were staged.
Abe later said he would give up his salary for the next three months to atone.
The meetings were patterned after similar
"town halls" held by
s, including Presidents Clinton and Bush, and were meant to gather public opin
ion on policy making. The hearings were introduced in 2001, long before Abe to
ok office in September.
But Abe was seen as instrumental in organizing the meetings in his previous ro
le as chief Cabinet secretary. Moreover, the meeting focused on education refo
rm _ a centerpiece of Abe's conservative agenda.
The government was forced to investigate the meetings after local media cited
participants as saying one in northern
public hearings, meant to gather public opinion on policy making, were put on
ice until the Cabinet's commission released its report on Wednesday.
The probe found that at 29 meetings, government officials posed as members of
the public and asked questions. Meanwhile, the government paid 65 regular citi
zens $43 each to ask questions at 25 hearings.
The planted citizens were told to make sure they didn't start off "I was told
to say," but their comments often clearly backed the government's plan to over
haul the education law to promote patriotism and civic virtue.
One person, cited in the Cabinet report, testified that; "I think we should re
consider once again on the state of our education and aim to realize a conside
rate society where everyone supports each other."
In some cases, the government staged meetings to spur debate or sent officials
to attend to compensate for low turnout, the commission said. But either way,
the results undeniably fueled suspicions that "public opinion was manipulated
in order to instill government policy," the commission said.

Mr Abe is paid 41.5m yen ($355,000) a year before taxes
emerged that officials had paid people to ask questions at public meetings.
The government inquiry also found that at some of the meetings - held over the
past five years - officials had pretended to be ordinary people.
Mr Abe, a cabinet minister at the time, was responsible for such meetings.
He said that as a way of assuming responsibility, he would return his salary f
or the next three months.

For the cynics who believe that when any politician meets the public it is all
stage-managed and choreographed, the news that the Japanese have been doing i
t will come as no surprise, our correspondent says.
He adds that the events, called town hall meetings, were supposed to be a new,
more open forum for discussion between ministers and voters.

But the inquiry found that officials coached people to make sure they asked mi
nisters what the government wanted them to.
In some cases they actually paid people to question ministers, or pretended to
be members of the public and questioned their bosses themselves.
The people in charge focused on the outward appearance rather than the origina
l purpose of the town hall meetings, the inquiry's report said.
It will fan suspicions that public opinion was misled in order to promote gove
rnment policy, our correspondent says.
But he says the report does not stop there.
The cost of these meetings, more than $188,000 (£95,000) each when they
started, was high enough.
But it turns out that, on a number of occasions, officials padded the bills to
suggest more government limousines were used than were actually needed to tra
nsport the VIPs.
